Wedding Photography Contract, Terms and Conditions
It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both Henry Szwinto Photography and the Client, in writing.
BOOKING FEE:-A fee of £150 is required at the time of booking in order to reserve the appointment. Payment may be paid by bacs, cash, cheque, PayPal, credit or debit card. Please make cheques payable to Henry Szwinto. BACS acc.no 94462880 sort code 09-01-26
PAYMENT:-Balance of payment is required 10 days before the wedding.
CREATIVE LICENCE:-The Henry Szwinto Photography shall be granted creative and artistic licence in relation to the choice of locations and poses used. Henry Szwinto Photography’s judgement on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. Henry Szwinto Photography will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
WEDDING PACKAGE:- The portfolio and editing style of photographs will be chosen by agreement between Henry Szwinto Photography and the clients and will be supplied in a number of formats as previously agreed and can include some or all of the following; Images available to clients and guests to download from www.szwinto.com, Wedding Book, CD, prints (various sizes available and/or mounted and framed), Acrylic mounted prints, Canvases, animated clips and videos. Coverage of the wedding will be by the number of photographers agreed before hand and from a pre agreed start time to a pre agreed finish time. Variations from the basic package may attract additional costs but will be stated and agreed beforehand.
COPYRIGHT:-The 1998 Copyright, Designs, and Patents Act assigns copyright to Henry Szwinto Photography. You may not copy the photographs taken under this contract, or allow copies to be made photographically, electronically, or by any other means unless specifically agreed in writing. This is a standard condition for most professional photographers.
FORCE MAJEURE:-In the unlikely event of total photographic failure, injury or sickness beyond Henry Szwinto Photography’s control, their liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected. Henry Szwinto Photography has full Public Liability and Professional Indemnity Insurance.
CANCELLATION:-If Henry Szwinto Photography has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid. If the Client cancels the appointment an unconditional refund policy exists up until 48 hours prior to the reserved slot at which point the Booking Fee will be retained by Henry Szwinto Photography.
POSTPONEMENT:-Should a cancelled wedding turn out to be a postponement, then, subject to Henry Szwinto Photography availability, all monies paid may be applied to the new wedding date. In this case, the total fees chargeable shall be the fee which applies at the time of the new date. In the event that Henry Szwinto Photography takes another booking for your cancelled or postponed wedding date a full unconditional refund of your deposit and monies paid shall be made.
COMPLAINTS PROCEDURE:-Please address any complaints to Henry Szwinto Photography by email or telephone as per our contact details. We expect to respond to any complaint within 2 working days of receipt.
PRIVACY:-Henry Szwinto Photography will store your name and address details on a private internal database. These details will not be made available to third parties. Should you wish to have your details removed from our database, please advise us in writing.
